2.1. Terms like “Personal Data”, “Processing”, “Data Principal”, “Data Fiduciary”, “Consent”, “Data Breach”, and “Board” shall have the meanings ascribed to them in the DPDPA.

2.2. Other capitalized terms used herein but not defined shall have the meaning given to them in the Terms of Use.

  1. a) Registration & Profile Data: Name, email address, phone number, password, address, user type (e.g., seeker, owner, agent), company name (if applicable), profile picture (optional).
  2. b) Property Listing Data (if You list properties): Property details (address, type, size, price/rent, amenities, description), photographs, videos, RERA registration number and QR code link (for applicable properties, especially in Maharashtra), ownership/authorization details.
  3. c) Search & Preference Data: Property search criteria (location, budget, property type), saved searches, favorited properties.
  4. d) Communication Data: Information provided when You contact Us (e.g., support queries, feedback) or communicate with other Users through the Platform (subject to monitoring for safety and compliance).
  5. e) User Generated Content: Reviews, ratings, comments, forum posts, or other content You submit to the Platform.
  6. f) Payment Data (for paid services): While We use third-party payment gateways, We may receive transaction confirmation details. We do not directly collect or store full credit/debit card numbers.

3.2. Information Collected Automatically:

  1. a) Log Data: IP address, browser type, operating system, referring/exit pages, dates/times of access, clickstream data.
  2. b) Device Data: Device type, unique device identifiers (or non-identifiable equivalents), mobile network information (if using a mobile app).

5.2. Legitimate Uses: We may process certain Personal Data without explicit Consent where it falls under the ‘Legitimate Uses’ defined in Section 7 of the DPDPA, such as:

  1. a) Processing data You voluntarily provide for a specific purpose (e.g., submitting a support query) where You haven’t indicated refusal of Consent.
  2. b) Compliance with Applicable Law or court orders.
  3. c) Responding to medical emergencies (unlikely for Our Platform).
  4. d) Purposes related to employment (for Our employees).

We will rely on Legitimate Uses only where necessary and proportionate.

  1. CONSENT

6.1. Obtaining Consent: We will request Your Consent at the time of data collection for purposes that require it. This will be done through clear language and affirmative actions (e.g., ticking a checkbox, clicking an “Agree” button). We will provide You with the notice required under Section 5 of the DPDPA before or when requesting Consent.

6.2. Managing Consent: You can manage Your Consent preferences through Your account settings or specific features provided on the Platform (e.g., email subscription management, cookie consent tool).

6.3. Withdrawing Consent: You have the right to withdraw Your Consent at any time for future Processing. Withdrawal can be done through Your account settings or by contacting Us (See Section 12). Withdrawing Consent will not affect the lawfulness of Processing based on Consent before its withdrawal. Please note that withdrawing Consent for essential Processing may limit Your ability to use certain features or Services.

6.4. Consent for Children: We do not knowingly collect Personal Data from individuals under the age of 18. If We need to process data of a minor (e.g., if listed as an occupant), We will obtain verifiable consent from their parent or lawful guardian as required by the DPDPA. If You believe We have inadvertently collected data from a minor without proper consent, please contact Us immediately.

We do not sell Your Personal Data. We may share Your Personal Data only in the following circumstances and with appropriate safeguards:

7.1. With Other Users: When You use the Platform to interact (e.g., contact a lister about a property), relevant information You provide or that is part of Your profile may be shared with the other User to facilitate the connection.

7.2. With Service Providers: We engage trusted third-party companies and individuals to perform services on Our behalf (e.g., cloud hosting, data analytics, payment processing, email delivery, customer support). These providers have access to Your Personal Data only to perform these tasks and are obligated not to disclose or use it for any other purpose.

7.3. With Affiliates: We may share Your Personal Data with Our subsidiaries or affiliated companies within Our corporate group for operational, analytical, or marketing purposes, consistent with this Privacy Policy.

10.2. Right to Correction and Erasure: You have the right to request the correction of inaccurate or incomplete Personal Data, the completion of incomplete data, the updating of outdated data, and the erasure of Personal Data that is no longer necessary for the purpose for which it was processed (subject to legal retention requirements).

10.3. Right of Grievance Redressal: You have the right to register grievances with Us regarding the processing of Your Personal Data. We are obligated to respond to Your grievances within a prescribed period. You must avail this right before approaching the Board.

10.4. Right to Withdraw Consent: You have the right to withdraw Your Consent at any time, as detailed in Section 6.3.

10.5. Right to Nominate: You have the right to nominate another individual to exercise Your rights under the DPDPA on Your behalf in the event of Your death or incapacity.

10.6. Exercising Your Rights: To exercise these rights, please contact Our Grievance Officer (See Section 12). We will respond to Your request in accordance with Applicable Law and within the prescribed timelines. We may need to verify Your identity before processing Your request.
